Centre files reply in PIL over sex-determination kits

Chandigarh, February 29 Surprised and shocked over the easy availability of sex-determination kits in the states of Punjab and Haryana, the Central government today filed its reply in an ongoing Public Interest Litigation (PIL) in the High Court.

In his affidavit, Director (PNDT), Ministry of Health and Family Welfare, Government of India, submitted that as of January 28, there are 415 ongoing cases in courts or with the police for various violations of the law. “Though most of these casesdeal with non-registration of centres/clinics, 63 cases relate to determination and disclosure of sex of foetus in states of Haryana and Punjab (18 each).

Moreover there are 42 cases pending against people who have placed advertisements about facilities of pre-conception, pre-natal sex selection in Gujarat (13), Haryana (5), Madhya Pradesh (3) and Punjab (5). An amount of Rs 5 lakh each has been sanctioned to 126 members of Parliament from the states of UT, Delhi, Gujarat and Haryana to create public awareness, reads the affidavit.

The Centre submitted that it is necessary to trap people importing sex determination kits, for which the cooperation of Customs Department is also required. Moreover, the websites giving such facilities also need to be stopped, the Central government submitted.
