CIC seeks encounter documents

New Delhi The Central Information Commission has asked the city police to submit all documents related the Batla House encounter on September 19 last year for the commission’s “inspection” .

The commission has given police time till March 5 — the police had earlier refused to part with documents related to the encounter that left Inspector Mohan Chand Sharma and two suspected militants dead.

After inspecting the documents, the CIC is to decide whether they could be disclosed under the Right to Information Act to applicants — in this case advocate Prashant Bhushan, who is representing Zia-ur-Rehman, son of the caretaker of L-18 flat in Batla House. The police claim Rehman is one of the conspirators of the serial blasts last September 13.

A directive to the police came on Tuesday from a bench presided over by Chief Information Commissioner Wajahat Habibullah. Habibullah and Information Commissioner Shailesh Gandhi had recently ordered a “representative of the DCP (Special Cell) to present the documents, copies of which have been sought Prashant Bhushan, before this commission on March 5, 2009”.

The CIC, under Section 18 of the Act, asked the police to furnish copies of the FIR registered by the Special Cell, postmortem reports of Inspector Sharma and two terror suspects killed in the encounter: Atif Amin and Sajid.

Bhushan, who filed an application earlier with Delhi Police seeking certain documents related to the encounter, was denied the information on the ground that Rehman, on whose behalf the application was filed, was “neither the complainant nor accused in the case at this stage”.
