Compensate American passenger for harassment, consumer body to Jet Lite

Chandigarh The District Consumer Disputes Redressal Forum has directed Jet Lite Airways to pay up Rs 2,500 for a flight delay causing harassment to a customer. The forum has also directed the airways to pay the equivalent of $300 in Indian currency as refund of the ticket.

The complainant, Bivake Gill, a resident of USA, through his representative in Panchkula here, said in his complaint that he had purchased a ticket from American Airlines on payment of US $1360.40 from Chicago to New Delhi and another ticket for the return journey on February 22, 2008 from New Delhi to Chicago.

The complainant was scheduled to leave for USA from Indira Gandhi International Airport, New Delhi, by American Airlines and booked his seat with Jet Lite Airways, which was scheduled to leave from Chandigarh at 5.20 pm on February 21, 2008 and reach New Delhi domestic airport at 5.45 pm.

As per schedule, the complainant reached the Chandigarh airport at 4 pm and kept waiting there till 8 pm.

The flight did not reach and finally it was announced that the flight has been diverted without assigning any reason, which put the complainant into great inconvenience as he was to report at IGI Airport at 10 pm to leave for Chicago at 12.55 am by American Airlines.

The complainant called up American Airlines and requested them to reschedule his flight upon which they rescheduled the flight for February 26, 2008 and again charged $1480.00 whereas the return ticket was valid upto April 14, 2008.

Due to cancellation of the flight, the complainant could not reach USA in time and could not resume his work and thereby suffered losses.

Even the airfare of Rs 2,620 from Chandigarh to New Delhi was not refunded by them.

Jet Lite Airways, in its reply, said that that the said flight had to come from Delhi on February 21, 2005, was diverted back to Delhi as a call was received around 5.45 pm by the Air Traffic Control (ATC), Chandigarh Airport intimating that the flight cannot be allowed to land due to poor visibility.

The forum said that the delay on the part of Jet Lite Airways in refunding the amount and thereby harassing the complainant was unfortunate.

“In fact, if there was any deficiency in service on the part of the airways, they should have promptly refunded the amount of Rs 2,620,” the forum said.
