The immigration firm has been asked not to charge Rs 64,000 in lumpsum and not to encash two cheques of Rs 15,000 and Rs 24,000 respectively. The firm has been further asked to refund the balance amount after retaining Rs 10,000 as professional fee.
The petioners, Dalbir Singh and Satwant Singh had approached Sunrise consultancy firm in Sector 8, through its consultant Kuldip Singh.
Dilbir Singh was interested in going to Australia on a Permanent Resident Visa.
After preliminary inquiries, Kuldip had assured the applicant that he would help them in acquiring the Permanent Resident Visa.
A contract of engagement for providing professional services for Australian Permanent Resident Visa was entered between the respondents and appellant on December 8, 2004.
Sources claimed that Kuldip Singh was aware that Dalbir Singh was not eligible for Permanent Resident Visa to Australia.
He however, said that Kuldip took Rs 36,000 in cash and two post-dated cheques amounting to Rs 39,000 from the petioners and did not reimburse the amount.
The firm claimed that that Dalbir Singh had signed an acknowledgement for voluntarily engaging services of appellants for immigration to Australia on October 30,2004.
They said that Rs 64,000 was settled as professional fee for the preparation and submission of application for the Australian Visa on behalf of Dalbir Singh and his family members.
