According to the prosecution, on February 27, 2008, Kamble picked up a fight with his wife Manjushi over a petty issue and started beating her brutally with a belt, which according to the police, was seized from the crime spot.

Prosecution’s argument was purely based on the dying declaration given by the deceased on three different instances. Manjushi had given dying declarations to her parents, a local social worker and the police minutes before she died at Sion Hospital. However, the prosecution failed to prove authenticity of any of her dying declarations in the court. “All the witnesses failed to stick to their original testimony before the court,” said defence lawyer Abdul Wahab Khan. Prosecution in all had examined 8 witnesses.
