Additional Chief Metropolitan Magistrate A K Kuhar expressed displeasure over the fact that the FIR, a copy of which was supplied to the counsel of the accused by Investigating Officer Suraj Prasad, was not readable and was written in a careless manner.
The matter came to light during a recent hearing when the counsel told the ACMM that though the police officer was obeying the court’s order by supplying her a copy of the FIR, it was of no help to her as it was prepared in one of the most lackadaisical ways.
The counsel said the handwriting of the policeman who had written the FIR was so poor that she failed to decipher anything.
“The copy of the FIR is not legible. I have seen it in the judicial file also. It cannot be read even with the help of a magnifying glass,” the ACMM said, observing that the IO should have supplied a legible copy of the FIR to the counsel.
The court directed the IO to furnish a “typed” copy of the FIR, duly attested by him, before it and to file it in the judicial file.
It also asked the IO to supply a proper copy of the FIR to the counsel of the accused who is facing prosecution for allegedly flouting the trademark of a company in 2005. A complaint regarding this was registered with the Kashmere Gate police.
