After senior advocate Arun Jaitley, appearing for Bhasin, urged the court to take a lenient view since the accused has been in jail for four months, the court issued a notice to the Delhi government, seeking to know their response. A bench of justices S B Sinha and Mukundakam Sharma granted two weeks’ time to the government to file a response.

Bhasin has filed an appeal challenging the decision of the Delhi High Court, where his bail plea was refused. The authorities had invoked the stringent Section 304 (culpable homicide not amounting to murder) of the IPC, which prescribes life imprisonment as maximum sentence, as the surviving victim, Mrigank Singh, alleged that after knocking them down the BMW dragged them for several yards before coming to a halt.
