Court stays grant of CLU to pvt company

Chandigarh, February 5 The Punjab and Haryana High Court has stayed the grant of Change of Land Use (CLU) to a private company by the Director Town and Country Planning.

Staying the CLU, the High Court also issued notices to the Director, Town and Country Planning; Land Mark Apartments Private Limited, Gurgaon and eight residents of Badshahpur, District Gurgaon.

The directions were issued on a petition filed by M/s Consolidate Realtors Private Limited, New Delhi (Pitampura).

The petitioner has sought directions to the Director, Town and country Planning, to not issue license with respect to the land located in Gurgaon. The company, petitioner in the case, has alleged it had already paid the scrutiny fee, collaboration agreements, general license fee, power of attorney and project report for the land which can be used for group housing.

The petitioner alleged that the Town and Country Planning director was bent upon issuing CLU to Land Mark Apartments Pvt Limited. The company submitted it owned more than 11.77 acres land and that the CLU be given to it.
