Circle Officer Mahesh Singh said on Wednesday: “No one saw the girl stealing the money. Moreover, according to the law, no activity is an offence if a child is below 12 years. At that age, one has not attained sufficient maturity to understand the nature and consequence of an action.”
Etawah Superintendent of Police K S Singh said: “The case has been expunged as no money was recovered from the girl. Also, since she was never left alone after the alleged theft, there was no possibility that she had hidden the money somewhere else.”
The expunction report has been sent to the relevant authority, which will decide on the action to be taken against complainant Anju Katheria.
On February 3, Katheria took the girl to the police station, suspecting that she had stolen Rs 280 from her while she was shopping in the local market.
Later, Sub-Inspector Shyam Lal and Inspector Chandra Bhan had tortured the girl. While Lal was dismissed, Bhan was suspended.
Under Section 182 of the Indian Penal Code, a person can be punished with imprisonment upto six months if he or she provides false information with an intent to cause a public servant to use his lawful power to injure another person.
