The complainant S P Bhardawaj said he purchased a Dish TV of New Era Entertainment Network from Paras Sales Corporation in Sector 35, which was installed at his house.
He also subscribed to the Dish Maxi Package by depositing Rs 300 per month. Bhardawaj was assured of world-class service, quality entertainment and uninterrupted viewing but reception was always erratic, he claimed. Further, the complainant had to spend Rs 200 for each visit of the mechanic.
In its written reply, Paras Sales Corporation pleaded that it was only authorised to sell Dish TV subscriptions but was not responsible for servicing and maintenance.
New Era Entertainment Network replied that the complainant had physically tampered with the dish antenna’s alignment resulting in non-receipt of the signals. “This is beyond the purview of the warranty as there has been no defect in the signals,” stated the firm.
The forum said that if the employees charged Rs 200 as fee for attending to the complaint, there could not have been any defect in transmission. “This means that the employees themselves tampered with the alignment to teach the complainant a lesson. This attitude is unfair and points to deficiency in rendering service. The complainant is an old man, a senior citizen, and the question of his tampering with the alignment of the antenna does not arise, when he could get it by paying a nominal charge,” the forum said.
The entertainment network has also been directed not to charge anything for the period when the present complaint was filed till the complaint is attended to by them to the satisfaction of the complainant.
The forum also said that the company would be entitled to a fee of Rs 200 when the complainant’s grievance is fully redressed. “If the complaint is not redressed within 30 days of the receipt of copy of the order, they are liable to refund Rs 4,000 (paid as cost of the Dish TV) to the complainant,” ruled the forum.
