Senior Superintendent of Police S S Srivastava, on Friday, ordered a re-look into the challan submitted in the court in the infamous Dimpy murder case.
The challan by the police in October last year virtually absolved the alleged main accused, Mukhtar Ansari, from the case. His name was not included in the document.
Moreover, the police failed to define the role of Harneev Dhillon, one of the suspects and main eyewitness in the case.
The police had submitted the challan after the arrest of the alleged main conspirator, Jaswinder Singh Rocky, in the murder of Prabhjinder Singh alias Dimpy. The police had arrested Rocky in July last year from Sector 11 and claimed to have recovered the weapon used in the crime.
The police stated in the challan that Rocky had admitted to have conspired to kill Dimpy, along with Sunil Kumar and Ravinder alias Bhau, on the directions of Ansari. Sunil and Ravinder had allegedly pumped seven bullets into Dimpy before escaping from the spot.
Ranjan Lakhanpal, a senior advocate of the Punjab and Haryana High Court, termed the challan an attempt to shield the main accused. “If the alleged main conspirator, Rocky, has made this statement that they killed Dimpy on the direction of Ansari, then Ansari is the main accused and his role should have been defined in the challan,” he said.
The police also did not mention the role or the statement given by Dhillon despite including her name in the list of eyewitnesses. Dhillon was also taken for a narco-analysis and brain mapping test last year.
Dimpy, 42, a notorious gangster who was facing over a dozen charges of contract killing and abduction, was gunned down by two motorcycle-borne assailants on July 7, 2006. He was shot dead near the Lake Club while he was in his car with Dhillon, who was also injured.
Lakhanpal said the main eyewitness is always instrumental for the prosecution to get the accused convicted. “It is surprising that the police did not mention her role and statements in the challan. It is a clear attempt to weaken the case in favour of the accused,” he stated.
Sources said Ravinder and Sunil, who are believed to have killed Dimpy, were lodged in one of the jails in Uttar Pradesh at the time of the murder. “If both the shooters, which the police claim shot Dimpy, were in police custody, it raises doubts on the entire investigation done by them,” Lakhanpal said.
“The role of main eyewitness should be defined in the challan. We are going through the challan once again,” SSP Srivastava said on Friday. He added that a team of the Crime Branch has been constituted to find out if the alleged shooters were in the custody of the UP jail authorities at the time of incident.
