Distance learning under cloud: HC notice to education council

Chandigarh, February 4 All is not well with the distance educational institutes running in the state of Haryana. The matter was highlighted by way of a public interest litigation (PIL) filed by Kartar Singh, a resident of Sirsa, who has sought directions to the State of Haryana; DGP, Haryana, and Director, Distance Education Council (DEC), IGNOU, to stop the illegal educational institutions running in the state.

A Division Bench headed by Chief Justice Vijender Kumar Jain has issued notices to the DGP, Haryana; Director, DEC, IGNOU, and others. Taking note of the serious allegations, the Chief Justice has also directed the petitioner to make all such illegally-run educational institutions party to the case. The petitioner has alleged that there are a number of educational institutions being run in shops and without adequate infrastructure. It has been further submitted that a report confirming the same has been submitted by the DEC.

It has been submitted in the petition that there are a number of illegal educational institutions running in Haryana offering their services in the state despite being affiliated to varsities in states other than Haryana, which is in violation of rules.

Directions have been sought not to promote a candidate who obtained a degree from these institutions, as it is mentioned by the DEC that these institutions do not fulfill conditions of the gazette notification issued on March 1, 1995, and are not approved by the DEC.

Thus candidates having degrees from such institutions are not valid for government jobs. The petitioner has further sought legal action against such study centres as they are openly running and selling degrees and diplomas in Haryana.

The petitioner has leveled allegations that a number of institutions are offering programmes through distance mode without authorisation or recognition by the DEC.

The petitioner has also given names of certain educational institutions which are being run in shops and directors of whom have been accused of “selling” the entrance examinations. He has also mentioned that the DC, Sirsa, had written a letter saying that a fake examination was also conducted in Sirsa by an educational institution.

Despite repeated representations, no action has been taken, the counsel for the petitioner argued. Issuing notices to the parties concerned, the Chief Justice has directed the counsel to make all such universities a party to the case.
