The EC instructions have already reached the Chief Secretary.

A few months ago, the CBI had filed a chargesheet against Gupta in a Lucknow court in connection with a case of alleged irregularities in some appointments made in the Information Department in 1988.

Despite the chargesheet, the state government allowed him to continue as home secretary. He is one of four home secretaries and deals with all matters relating to IPS.

Asked about the EC directive, Chief Secretary Atul Kumar Gupta said the government is to give the compliance report to the Commission by February 20. “There is still time,” he said.

The Chief Secretary said the government will implement all instructions of the Commission. It will have to see if the court had taken cognizance of the cases filed against officials.

Asked specifically about the fate of Mahesh Gupta, the Chief Secretary said, “I can’t say anything”.

CBI lawyer K P Singh said the court is yet to pass an order taking cognizance of the case.

Official sources said an interesting case could be K Satyanarayan, an official with the Election Cell in the DGP office, who figured in the police recruitment scam and was also suspended, but the government did not give sanction to prosecute him.

The EC has already asked the Chief Secretary to undertake a detailed review of officers. Officers posted in their home districts should be transferred. Those who completed three years of the last four years in their current posting, will have to be transferred as well.
