Forum moves SC over Centre’s move to de-seal commercial properties

New Delhi, February 5 A citizen's forum on Tuesday challenged the Constitutional validity of the Central government's recent notification permitting de-sealing of commercial premises.

“The notification is totally arbitrary, illegal and unconstitutional in as much as such notification empowers the local authorities to de-seal properties which have been sealed under the orders of this honourable Court,” said the Delhi Pradesh Citizen Council in an application filed through advocate Jasbir Singh Malik.

The applicant alleged the notification was “issued for political consideration to overreach judicial order”. It recalled that the apex court repeatedly had said there cannot be de-sealing of any premises without the court's prior approval. It also pleaded the court to declare the impugned notification dated January 31, 2008 as “unconstitutional, unjust and illegal”.

Seeking a stay of the operation of the notification issued by the Union Ministry of Urban Development till the final disposal of the writ petition, Malik alleged it was aimed at protecting violators of civic laws at the cost of law-abiding citizens of Delhi.
