Finding prima facie sufficient incriminating material against Lieutenant Colonel J K Bhagat, who was head of the Nuclear Medicine Department at the Delhi Cantt-based Army hospital here, and Gagan Khanna, Additional Sessions Judge I K Kochhar directed that charges be framed formally against the duo on March 11.
“The criminal intent on part of both the accused persons is prima facie borne out from the circumstances and context in which these acts were committed,” the court said in an order on Wednesday.
The accused have been charged under provisions of the Prevention of Corruption Act and those of the IPC, pertaining to cheating and criminal conspiracy.
According to the CBI, Bhagat, in collusion with Khanna, who was the proprietor of M/S Kent Industries, had given a go by to the procedural prerequisites in forwarding fictitious medical bills and paying money to Khanna’s firm in advance for the drugs that were never procured.
The alleged fraud was detected during a surprise check carried out by the Ministry of Defence at the hospital in April, 2002, after only 9 vials of the said medicine were found in the custody of the Nuclear Medicine Department, whereas they should have been as many as 36 according to the purchase orders forwarded by Bhagat.
