Govt can’t recover Re 1 fine from ex-officer guilty of witch hunt

Kolkata The state government today told the Calcutta High Court it could not realise the fine of Re 1 imposed on former State Vigilance Commissioner of West Bengal S K Dutta for harassing senior police officer Nazrul Islam but said it had paid the fine amount to the latter.

The government said it had already requested the Centre to decide on the realisation of money from Dutta, a retired IPS officer. Only the Centre could decide on the realisation of money from Dutta, said Pratik Dhar, counsel for the state. Today, Justice Dipakar Dutta disposed of the petition filed by Islam, who is

IG (welfare). After hearing the petition filed by Islam, Justice S P Talukdar had held on June 25, 2008 that the inquiry conducted by the State Vigilance Commission against him was not legal. Justice Talukdar had also directed the state government to pay Re 1 to Islam as compensation for harassing him.

The Calcutta High Court had also asked the state government to realise the money from the person who was responsible for such illegal inquiry against Islam. Again, Islam filed a writ petition in 2010 alleging the state government had not conducted inquiry to find out the person who was responsible for harassing him by initiating an illegal inquiry by the State Vigilance Commission. Following the petition, the government apprised the HC on April 16, 2010 that Dutta was responsible for harassing Islam.
