ICICI to shell out Rs 50,000 for misusing customer’s post-dated cheque

Chandigarh The District Consumer Disputes Redressal Forum today directed ICICI Bank to pay Rs 50,000 compensation to a resident of Panchkula for misusing his post-dated cheque for withdrawing money without his knowledge.

The complainant, Baljit Singh Malik, said he had taken a loan of Rs 3.5 lakh from ICICI Bank to purchase a Ford Ikon car, in January, 2005. He was to repay the loan amount in 47 instalments of Rs 10,000 each.

Malik said he bought the car and the bank started recovering the loan through post-dated cheques.

The complainant alleged that the bank took away the car through its recovery agents in June 2006 and sold it to another person.

Malik then approached the bank and asked them to return the remaining post-dated cheques and the no-dues certificate, which the bank refused to do.

The complainant alleged that the bank used one of the post-dated cheques and withdrew Rs 30,000 from his account without informing him. He then moved the forum, alleging deficiency in the service of the bank and accused it of unfair trade practices.

The ICICI Bank, in its reply stated that the vehicle was handed over to them after the complainant failed to deposit the EMIs. They said that they also gave a notice to the complainant before disposing the car.

The forum, meanwhile, found the bank guilty of indulging in unfair trade practices and directed them to pay a compensation and return all the post-dated cheques and issue a no dues certificate.
