Jitender Kumar said his car met with an accident on December 6, 2007 and was extensively damaged.
As per the advice of the company, the complainant said he took the car to an authorised dealer who issued estimates worth Rs 5.50 lakh. The company, however, failed to settle the claim, following which Kumar moved the consumer forum.
The company said in its reply that the net claim payable was assessed at Rs 3,66,157 by the surveyor. It further stated that the estimate given by the workshop is not final in any manner as it also contains estimate of those parts which can be repaired. The firm claimed it had asked the complainant to get the vehicle repaired and provide copy of the bills to enable them to process the claim, but he failed to do.
The forum said that the repair estimate of Rs 5,37,632 given by the complainant has not been accepted by the company.
“The surveyor has assessed the value of the parts at Rs 4,14,462.56 and by deducting Rs 89,650.71 as depreciation, the value of the parts was assessed at Rs 3,24,811.85. The total labour charges were estimated at Rs 52,345 and in this manner according to the surveyor the complainant was entitled to Rs 3,66,157,” the forum said.
