Kasab’s case to be committed to special court today

Mumbai With over 11,000-page chargesheet filed in the 26/11 case, the metropolitan magistrate court will commit the case to the designated special court set up inside the Arthur road prison on Monday.

The three arrested accused — Kasab, Faheem Ansari and Sabauddin— along with 35 absconding accused have been booked under various sections of the Indian Penal Code (IPC), the Foreigners Act, Unlawful Activities (Prevention) Act, Arms Act, Explosives Act and the Customs Act.

Although the two arrested Indians, Ansari and Sabahuddin, have defence lawyer, Kasab is yet to get any legal aide. Special Public Prosecutor Ujjwal Nikam confirmed that a legal aide will be made available only after the case is committed to the sessions court, with three options available — the Pakistan government may look for a lawyer for Kasab; Kasab may urge or choose his own lawyer; or, if till the time the case reaches the sessions court, if Kasab has no lawyer, the court may give Kasab a lawyer from the state’s legal aid cell.

Meanwhile, Ansari and Sabahuddin have requested Urdu translation of the 11,000-page chargesheet. On March 6, the duo moved an application before the magistrate court stating that the chargesheet filed by Mumbai Crime Branch was in English and Marathi and that they do not understand these languages. Order on the application is also expected on Monday.
