Khadim case: HC rejects Happy Singh’s plea

Kolkata The Calcutta High Court on Tuesday held that Harpreet Singh alias Happy Singh should not be allowed to appear in court in other states.Singh, one of the main accused in the Khadim case, is in jail since 2001.

Singh had filed a petition recently alleging that the West Bengal government did not allow him to appear in criminal courts in Delhi, Gujarat and Haryana.

Singh alleged the state government had violated natural justice as well as Article 21 and 14 of the Constitution. He sought an order allowing him to appear in criminal courts in other states.

On various occasions, criminal courts of other states had issued summons to Singh for appearing in various criminal cases. But the state government decided against allowing him to go to other states under police security.

The government had issued an order under 268(1) of CrPC declaring him a dangerous person.

Subrata Mukhopadyay, Junior Standing Counsel of the state government, pleaded that Singh maintained contact with various terrorist groups and also anti-national outfits. He even made a bid to break the wall of the jail.

“It is the apprehension of the state government that Singh may escape during transit from West Bengal to other states,” said Mukhopadyay.

After the hearing, a Division Bench of Justices Girish Chandra Gupta and K K Prasad of the Calcutta High Court rejected the petition of Singh.

Singh had been arrested in connection with the abduction of Partha Roy Burman, owner of Khadim, in 2000.
