KMC mulls legal action against Railways

Kolkata The struggle between the CPM-controlled Kolkata Municipal Corporation and Railway Ministry, headed by Trinamool Congress chief Mamata Banerjee, over Basanti Colony has taken an ugly turn.

The KMC is contemplating legal action against the Railways, as the latter has filed a complaint with the Ultadanga police station against three senior civic officials, including the Municipal Commissioner Arnab Roy, in connection with the encroachment of Basanti Colony land.

The Railways, which had moved court against the KMC and the Kolkata Improvement Trust (KIT) for allegedly encroaching land in Basanti Colony, filed an FIR on February 7 against senior officials of the civic body and the KIT for “hooliganism and criminal intimidation”. In the FIR, the Railways had named three officials — Municipal Commissioner Arnab Roy, DG (building) of the KMC Gora Chand Mondal and Chairman (KIT) Tuhin Bera.

All the three officials have been charged under Sections 166, 120(B) and 506(II) of the Indian Penal Code, including the clause of a public servant disobeying the law with intent to causing injury to any person, criminal conspiracy and criminal intimidation.

“The FIR will not stand. The Railways don’t have the possession of the land, which they have mentioned in the FIR. They want the KMC and KIT to evict slum dwellers and handover the land to them. The government will never do that. Instead we will construct houses for them. We will take legal actions against the Railways on the issue,” said Mayor Bikash Ranjan Bhattacharya.

Chairman of the KIT Tuhin Bera said the land have not been encroached by them as no permanent construction has come up in the area. “The KMC or KIT is not carrying out any permanent construction in the area. Only temporary constructions have come up there,” Bera added.

After a major fire broke out at Basanti Colony in January, leaving 450 families homeless, both the CPM and Trinamool have promised to set up dwelling units for the affected people.
