Partha Pratim Banerjee, father of Srijon, had lodged a complaint at the Shakespeare Sarani police station on April 2, alleging that Smart had demanded a laptop to facilitate his son’s promotion from Class IV to V. Sanjay did not get promotion as his father failed to meet the teacher’s demand, Banerjee alleged.
Smart had also warned Banerjee through an SMS. Smart had filed an anticipatory bail petition last week to avoid arrest.
Last year, Srijon failed to get promotion. Following this, Smart approached the family and became close to them. Banerjee reportedly gave an old desktop to the teacher, but Smart was not satisfied with it.
On March 29, Srijon came to know that he had not been promoted this year too. The school authorities offered Banerjee to take a transfer certificate for Srijon.
Following this Banerjee lodged a complaint against Smart. The police had registered a case under section 384 (extortion), 506 (criminal intimidation) of IPC and other criminal charges.
Sandipan Ganguly, counsel of the state pleaded that there was enough material against the teacher. So the court should not grant anticipatory bail to him.
Ganguly said that the police have failed to trace the teacher and he was absconding.
Delivering the order, a Division Bench of Justices Amit Talukdar and Ragunath Ray said that there was sufficient material for rejecting the anticipatory bail plea.
