Lawyers’ strike over, will join work today

Chandigarh The day-long strike by practising lawyers of district courts against amendments in Section 41 and 309 of the Criminal Procedure Code (CrPC), partially affected work in courts on Monday.

Referring to the strike as a success, N K Nanda, president, Chandigarh District Bar Association said: “Our aim was not to harass the people but to give the government a signal not to make any amendments. The lawyers will join work from tomorrow.”

Bar associations across the country have called a nation-wide strike on February 3.

According to the proposed amendments, trial of rape cases should preferably be completed within two months. Moreover, to ensure a speedy trial, the court shall not adjourn the case on grounds of the lawyer’s engagement in another court or his inability to attend court due to an illness.

Also, no arrest would be required for cognisable offences such as molestation, dowry harassment and attempt to robbery, which invites a maximum punishment of up to seven years imprisonment.

Ajay Chaudhary, president, Panchkula Bar Association, said: “We are opposing amendments in Section 41 and Section 309 of CrPC. The amendments will take away certain categories of offences under Sections 41 and 309 of CrPC and will give the police mandatory power to arrest anyone.”
