Lawyers voice oppositionto CrPC amendment bill

Ludhiana THe District Bar Association (DBA) members under the leadership of its president, Parupkar Ghuman on Monday observed a day-long strike to oppose to the amendments to the Criminal Procedure Code (CrPC) that removed the mandatory arrest provisions for offences punishable with jail terms of up to seven years.

Addressing the DBA members, Ghuman said, “It is wrong on the part of the government to introduce such a bill in Parliament without taking the legal fraternity and bar associations into confidence.”

Ghuman further said that the proposed amendment was likely to be misused over its discretionary powers to shield the culprits by the police department as well as politicians and could give a free hand to scamsters, unscrupulous elements and other offenders without any fear of being arrested.

The legal spokesperson of DBA, Harpreet Sandhu, said, “The proposed amendment to remove mandatory arrest provisions in the offences punishable with imprisonment up to seven years would remove fear from the minds of criminals, who will misuse the provisions under the garb of personal liberty.”

He said that the Supreme Court Bar Association had already opposed this amendment Bill, which was passed by Parliament on December 23, without any discussion as on that day eight bills were passed in 17 minutes, and has also received the Presidential assent. But it is likely to be challenged in the Supreme Court when it is notified by the government to enforce the amendments, he said. The lawyers and other members of the DBA, Ludhiana, also lent their support to the strike.

Only wearer knows where show pinches. I really appreciate this move. Now the extortion will come to a stall. Under the garb of these 498A and DV act, many intimidate and ruin families. A really good lesson to tell them that LAW IS NOT BLIND. Keeping my fingers crossed and pray it soon becomes the law. Hats off to President for she, though being a female, have eventually understood the agony a innocent man has to go through when undue demands of in-laws are not met.

Recent amendment in the CrPC is motivation to the crime and it's seems that same was not proposed/made by the law maker but the law breaker. This is against the deterrent theory of law.
