In this regard Manoj Kumar Khosla, Government Food Inspecter, had filed a complaint under Sections 16 (I) (a) (i) of the Prevention of Food Adulteration Act, 1954 before the court against accused Surinder Singh and alleged that on September 18, 2002 he along with Dr R C Garg, District Health Officer (DHO), had inspected the premises Anand Flour Mill and also taken a sample of wheat flour (atta) from the accused who was found in possession of about 40 quintals atta for sale for human consumption at his premises. M K Khosla further alleged that he purchased atta from the Surinder Singh and after that the sample was sent to the Public Analyst as it was found to be adulterated as the sample contained rice starch as an admixture. Complainant alleged the accused has violated the provisions of
Section 7 of the Act.
On the other hand, the accused pleaded innocence and claimed false implication, but no defence evidence has been produced by him before the court. Pronouncing the verdict, the court held that the prosecution had successfully proved the guilt of the accused and sentenced accordingly.
