Nisha Chainani, producer and director of the film titled 42 kms, had approached the High Court following a status-quo order passed by the Debt Recovery Tribunal (DRT) earlier this month. Standard Chartered Bank had approached the DRT in December 2008, seeking to defer the film’s release till the producer repays a loan of Rs 1.24 crore, along with interest charges.
The division bench of Justice J N Patel and Justice K K Tated asked the producer-director to wait for the order of the DRT, which is likely to come this week.
The court said in the event the DRT rules against the producer, she can approach the Debt Recovery Appellate Tribunal (DRAT). It, however, observed that the DRAT pass an appropriate order as per the provisions of law considering the urgency of the matter.
