Maruti Suzuki fined for unfair trade practice

Chandigarh, November 12 The District Consumer Disputes Redressal Forum has directed Maruti Suzuki to pay Rs 10,000 as compensation for adopting unfair trade practice.

The car manufacturing company is in the dock for issuing a wrong sale certificate to the complainant, who later alleged he was sold an old model despite paying for the latest one.

The forum also directed the Registering and Licensing Authority (RLA) to issue a fresh registration certificate to the complainant free of cost, mentioning the month and year of manufacture of the vehicle as January 2008.

The RLA had earlier listed the date of manufacturing as December 2007.

In January this year, complainant Surinderjeet purchased Maruti SX4 ZXI model from Chittosho Motors in Mohali and paid Rs 7,19,979.

In the insurance certificate, the year of manufacturing was 2008, but when he applied for a permanent number through the RLA, he was given the certificate of the model of December 2007. After the 'mistake' was communicated to the company, he was issued a fresh certificate showing the car as manufactured in 2008.

The RLA, however, refused to change the month of sale on the grounds that the year of manufacturing of the car was December 2007 according to its chassis number print and its original sale certificate form.

In its reply, Chittosho Motors admitted that the car was manufactured in 2007 and the documents were also issued pertaining to the same year, 2008. It was pleaded they could not be held liable for the acts and omissions made by the said sales manager of the car company.

Maruti Suzuki, in its reply, said the contract for the sale of the vehicle was with the Chittosho Motors who settled the terms and conditions.

They also denied issuing any document of sale to the complainant or if they were responsible for issuance of registration certificate.

The forum ruled that the vehicle was manufactured by Maruti, so they know the exact month and year of its manufacture while the entire written reply filed by it does not suggest anything regarding the same.

“It shows the tendency on the part of Maruti to conceal correct information not only from the parties, but the forum as well. Chittosho Motors as well as Maruti have been the most negligent in rendering proper service, due to which the complainant was harassed,” said the forum.
