In response, MCD Commissioner A K Nigam said there seemed to be some confusion regarding the High Court's orders. “According to High Court's orders, action should be taken against any structure or construction not covered by the Masterplan 2021 and other ordinances and rules, which includes the fourth and fifth floors,” Nigam said.
"The MCD argued before the High Court on December 18 that the directions of the Monitoring Committee regarding demolition were against public welfare. The High Court did not give any direction, but fixed January 4 as the next date of hearing. The Standing Committee in its meeting held on December 13 passed a resolution that the MCD would not demolish fourth and fifth floors. Necessary directions to the MCD in this regard were also issued. Neither the High Court nor the Monitoring Committee has issued directions to demolish the fourth and fifth floors after December 28. I cannot understand the haste in demolishing these structures before the court hearing," Sharma said.
