A Division Bench comprising Chief Justice Mohit
S Shah and Justice Kalyanjyoti Sengupta has asked the state government to submit a report by July 9, detailing the status of implementation of the scheme in Kolkata district.
The orders come in response to a PIL filed by various state rights organisations, including West Bengal State Education Chapter, MASUM and Campaign Against Child Labour (CACL), after survey reports revealed the scheme was not functional in 70 per cent of schools in Kolkata district.
Debasish Banerjee, the lawyer of Human Rights Law Network, which filed the petition with other NGOs, said the Bench observed that if the contentions of the petitioners are found to be true, this could qualify as a violation of Supreme Court orders and could also amount to contempt of court.
Based on the report of the state government in 2009, the West Bengal State Education Network conducted a survey in 51 schools in Kolkata in January this year. The survey revealed that only 12 of the 51 schools surveyed had midday meal provisions.
