However, a division bench of Justice Bilal Nazki and Justice A R Joshi directed the Municipal Commissioner Jairaj Phatak to state this on the affidavit before the next hearing on March 18. BMC counsel K K Singhvi stated that the inquiry is on and till then no action will be taken against any staff. He also said they will not pay any compensation at this stage.

Following a court direction, DCP Zone IV, who was on leave, remained present in the court on Friday. The DCP was heading the special team that was tracing the baby and the kidnapper. However, the DCP had gone on personal leave to Nashik for past few days. This had attracted the ire of the judges on Thursday.

The judges on Friday stated that the DCP can be relieved of all other duties till the missing child is found and asked the police to give a deadline.

Public prosecutor Satish Borulkar told the court that no officer can give such a deadline. The court observed that the DCP has not even monitored the investigation. If he had done that, he would have found the child by now, the court said.

“We will be enjoying Holi. The parents also should be able to enjoy it,” the court said. The court had remarked that it was not satisfied with the report as no proper effort had been taken. The court had, however, stated that they don’t doubt the competency of the Mumbai police.

The court had earlier asked the BMC to pay a compensation of Rs 10 lakh to the parents of the baby. But, the BMC later responded by stating that they were willing to pay Rs 5 lakh.
