Gafoor, who was present in court as per the earlier order, submitted that a Special Investigation Team has been constituted under DCP Zone IV to locate the missing baby.
Meanwhile, the BMC has informed the court that an inquiry committee headed by the dean of Nair Hospital has been constituted to fix the responsibility in the case.
The court has also taken note of the submissions from the hospital which has now beefed up the security and has also installed CCTVs to prevent such an incident in the future. Other measures are also in the offing, the hospital has assured the court.
Meanwhile, the division bench of Justice Bilal Nazki and Justice Anoop Mohta has stayed the suspension of the doctor and nurse suspended last week based on court directions.
The suspension was stayed after BMC counsel K K Singhvi and advocates appearing for the doctor pointed out that the doctor and nurse were only clinically responsible and were not in charge of the ward. “Suspension has been stayed till responsibility is fixed,” Justice Nazki stated.
The court also observed that the corporation has taken the matter with some seriousness and directed that the enquiry committee should file a report in a sealed envelope within 10 days.
The court has also directed the SIT to file progress report in a sealed envelope every week with the Registrar of the High Court. During the arguments the court questioned as to who can be held responsible.
The corporation, however, was not ready to fix the responsibility on the hospital, the dean or the doctors.
“Please tell us whose fault it is. Who allowed the person to come there,” Justice Nazki asked. The judge also indicated that the suspension of the doctors will continue and even the dean will have to be suspended.
Meanwhile, petitioners’ lawyers Ashsish Chavan and Amit Karkhanis produced a copy of the FIR to refute the corporation’s claim that the baby was handed over to the unknown lady by the mother while she went to the bathroom.
Singhvi submitted that only in Bombay the corporation has good hospitals with good administration. “So why should you spoil it now,” Justice Nazki asked. The court was also told that it might have been a lapse on the security.
