Lucknow A non-bailable warrant (NBW) has been issued against state Bahujan Samaj Party (BSP) president and Cooperatives Minister Swami Prasad Maurya for failing to appear before the court in connection to a case lodged at Rae Bareili.

In 1987, head constable Ram Surat Upadhyay, attached with the Fire department, had lodged an FIR against Maurya and two others under various sections including attempt to murder. According to Upadhyay, while he was on his way to a petrol pump in a fire department vehicle, people demonstrating at the Murari Ka Bagh crossing over water supply, had pelted stone at the vehicle and misbehaved with the fire staff. Maurya was allegedly present at the spot when the incident took place.

A named FIR against three persons and 20 unidentified people was lodged at the Dalmau police station in Rae Bareili. Two years later, the police filed chargesheet aga-inst three persons, including Maurya. In 2003, the state government moved an application before the court to withdraw the case but the plea was turned down.

Prosecuting officer S B N Singh said, “Since Maurya did not appear before the court, his case did not go for trial. The other accused have gone to trial and were acquitted.”

He added the state government had later also moved an application before the court to withdraw the case. “The court, apart from rejecting the plea, had issued a warrant against Maurya,” Singh said. The next hearing has been scheduled for March 3.
