The petitioner company is a concessionaire in implementation of Delhi-Gurgaon Expressway project. The company has approached the court demanding directions to Haryana and authorities to support, co-operate with and facilitate the company in implementation of the project.

The company has sought assistance of dedicated police teams to assist in collection of lawfully authorized toll, to ensure safety and security of life and property and to regulate traffic at two toll plazas — KM 24.00 Dundahera border and KM 42.00 Kherki Daula, National Highway 8 District Gurgaon, Haryana and along Delhi-Gurgaon Expressway.

The company has submitted that it has invested Rs 1,000 crores on construction of expressway which became operational on January 23, 2008. The company is entitled to collect toll at these toll plazas from traffic coming from both directions.

“Law and order situation at toll plazas is grim and the company is helpless in face of musclemen browbeating the toll attendants and refusing to pay toll. Residents of 43 villages have refused to pay toll charges and intimidate toll collection staff at the toll plazas” reads the petition.

The company has submitted that it is ready and willing to provide adequate space and bear entire cost for providing police assistance and for setting up and maintaining police posts at two toll plazas. “The company is unable to enforce collection of toll in the absence of adequate police personnel providing constant and immediate security as required,” reads the petition.

The company has strongly deplored the fact that the Haryana authorities have failed to discharge their duties and responsibilities.
