Notices issued to AMC following contempt plea from dargah

Ahmedabad A city civil court has issued notices to the Ahmedabad Municipal Corporation (AMC) following a contempt plea from the Hazrat Geban Shah Pir Dargah in the matter of right of passage to the dargah.

At present, the structure comes within the cordoned off Kankaria Lake Front area. The notice is returnable on January 21.

In its plea, the appellants submitted before the court that action will be taken against the respondent municipal corporation for openly violating the undertaking given before the court and the High Court in the matter of civil suit number 3080/2003 as this amounts to contempt of court.

They have also sought a direction to the AMC to compensate them for the damage caused to the dargah structure and restore the construction and approach road in the original form.

Civic officials not only refused to follow the direction in the court ruling dated December 4, but said they had nothing to do with the orders and that they would do only what their seniors would tell them, according to the appellants.

The AMC ultimately broke the platform leading to the shrine and contented seeking its restoration.

According to the appellants, when it was pointed out that disturbing the original structure and its approach road would attract contempt of the court, the officials said they were free to move the court and that officials were willing to undergo punishment for that.

In another case, the municipal corporation is already facing flak for damage to the plaque installed at Naginawadi. The Hauz-e- Qutub built in the mid-fifteenth century by Sultan Qutubuddin for his soldiers to perform pre-prayer ablutions at the nearby Idgah. The plaque was found defiled during the implementation of the renovation project of the lake and Naginawadi.

Municipal Commissioner I P Gautam said the absence of plaques or otherwise did not as such “displace historical facts… no one looks for a plaque at the Lal Qila and yet everyone knows about its origin,” he said.
