The Committee will also organise a motor rally from Patiala House courts complex to the India Gate on the same day, to mark their protest against the amendments in the Code of Criminal Procedure that forbid the mandatory arrest of the accused in offences carrying punishment of up to seven years in jail.
The decision was taken in a meeting held on Thursday, where Rajiv Khosla, the spokesperson of the committee said over 600 Bar members have expressed solidarity with them and will participate in the strike.
“It is extremely unjustifiable that the adjudication power of the magistracy to grant bail has been given to the police, who had the limited role of conducting investigations till date,” Khosla said.
Dubbing the move as an “encroachment on the judiciary’s power”, he said this was the first time the Parliament showed more faith in the police than the judiciary, and the justice disposal system as a comprehensive process.
On the lawyers’ future course of action, Khosla said: “The Committee might consider moving the Supreme Court in a writ challenging the legality of the amendments as against constitutional provisions.”
The Committee has also decided to stage a demonstration outside the Parliament on February 18 and meet Members of the Parliament, including the Leader of Opposition, to apprise them of the situation.
