The Sewree Sessions Judge V B Khamkedkar sentenced Nawabuddin under various sections of the Foreigner’s Act, Arms Act and Explosives Act and also imposed a fine of Rs 1,000 on him. According to the prosecution, the accused had come to India and was arrested by the Anti Terrorism Squad (ATS) of the Maharashtra Police on August 22, 2006, from Wadala.

Acting on intelligence inputs, the police had intercepted a Maruti van (GJ-17-AB-3976) near Wadala Truck Terminus past midnight on the day. A search of the vehicle, driven by Nawabuddin, led to the recovery of a Chinese pistol, five live cartridges and 1.5 kg of a white powder. Police also recovered Rs 1,450 and $50, two sets of registration number plates bearing numbers GJ-15-M-7353 and MH-04-AW-9459, along with a red pocket diary which had some Bangladesh telephone numbers and three maps: of the world, Maharashtra and Mumbai.

During interrogation, Nawabuddin told the police that he was from Pakistan. He also told the police that his accomplice was hiding in one of the apartments in the deserted government colony in Sector 7 of Antop Hill suburb. He led the police team to the apartment. But on reaching there, they were fired at from an AK-47 by Mohammed Ali who died in the cross firing. The AK-47 and 72 live rounds were later recovered from the apartment, which did not have any furniture or utensils but had some food and clothes.
