Remove hawkers from bridges, railway premises: HC

Mumbai The Bombay High Court on Wednesday directed the railway authorities to remove all illegal hawkers from foot-over-bridges and railway platforms and premises.

A division bench of Justice J N Patel and Justice K K Tated has orally directed the railways to remove all unauthorised hawkers at railway premises and FOBs.

The HC was hearing a petition filed by Central Railways Shopkeepers’ Premises Co-Operative Society, a group of 35 shops outside Kurla railway station in central suburbs, seeking that railways should not take action against the illegal hawkers. Railway counsel Suresh Kumar submitted that the shops are causing obstruction to the commuters and they have no right to stay there. He also pointed out that the city civil court in October 2008 had rejected the society’s application seeking similar relief.

The society had moved the court challenging a notice issued by the railways under the Public Premises Act for removing shops.

“Railways should remove all the encroachers and hawkers from all the platforms and FOBs,” Kumar said. “Court did not grant any relief or stay in view of Supreme Court judgement. Now the RPF will have to drive away these hawkers whenever they come for business on railway premises,” he added.
