Gill had got his grand-daughter twins Mehrunissa Gill and Niloufer Gill, aged seven, registered with Kundan International School after paying the registration fee of Rs 500 each in November 2006. Later both the girls, after a written as well as oral tests, were admitted to Class III with a fee of Rs 31,000 each.
As Gill’s son was settled and working in Canada, his daughter-in-law Priyanka Gill and both the grandchildren left for Canada on May 17, 2007, to stay there as required under Canadian laws for Canadian citizenship.
On March 5, 2007, the school was informed that since the children were facing legal problems in obtaining citizenship, their admission be cancelled and the full amount be refunded as the school was yet to commence the session. The school refunded an amount of Rs 16,000 per child after a lot of pestering but withheld the remaining Rs 15,000 per child, amounting to a total of Rs 30,000. A legal notice was also served to the school but to no avail.
While deciding the case, the Forum stated the school was not at all justified to charge fee from the complainant especially when the classes had not commenced. Moreover, the intimation for cancellation of admission was submitted by the complainant way before the start of the session. At the most, the school could retain only the registration fee amounting to Rs 500 per child. Under the circumstances, when no services have been rendered, the school needs to refund the balance fee of Rs 30,000.
