The matter relates to the mass burial of the bodies of the victims of the massacre, off the Panam River outside Lunawada town of Panchmahals district by the local administration.
In a special leave petition before the Supreme Court last week, the NGO has now sought the Gujarat High Court’s intervention for a favourable order to this effect. CJP said despite the Supreme Court’s orders, the Gujarat government did not take any action for the expeditious and dignified burial of identified bodies.
The NGO said the victims were buried in the mass grave despite the presence of a 300-acre graveyard belonging to another sect of the Muslim community in the town. This apart, the remains were also buried in the same clothes the victims were massacred in, raising questions about the manner in which the post-mortems were conducted, CJP said.
Following a dig-up by the relatives of the victims, the Supreme Court had ordered a CBI intervention into collecting of blood samples and testing of the DNA of the victims on December 29, 2005. Following the tests, the reports of which were submitted by May 2006, six of the 20 skeletal remains were found matching the survivors of the massacre.
The bench of justice B N Agrawal and justice G S Singhvi, however, directed the petitioners to put an application before the Gujarat High Court and ordered expeditious hearing for the same. CJP said it was now planning to move the trial court shortly.
