Gurmail Singh, a resident of Rasoolpur village, told the police that Mohanjit Singh and some other boys used to stand near the school in their area. Gurmail’s brother Sewak Singh objected to it.
On this, an altercation took place between Sewak Singh and Mohanjit Singh two-three times. The matter was resolved with the intervention of the Panchayat, but Mohanjit felt offended. He alleged that in August 2003, Sewak Singh was going to the fields on his cycle when he saw Mohanjit Singh, his brother Naib Singh, father Karnail Singh, uncle Jarnail Singh, and three more persons, Gurnam Singh, Mukhtiar Singh and Darshan Singh. These persons, who were carrying sharp edged weapons, attacked Sewak Singh.
When Gurmail Singh went to save his brother, he was also attacked. When they raised an alarm, the villagers reached the spot, and the accused fled away.
Gurmail Singh and Sewak Singh were rushed to Civil Hospital, with serious injuries. During the arguments, the accused pleaded not guilty and false implication, but the judge decline the plea. Pronouncing the verdict, the court held that the prosecution had successfully proved the guilt of accused and sentenced accordingly.
