Singapore-based IT firm files ‘cyber-defamation’ complaint

Chandigarh, February 25 For the first time in the history of Chandigarh Police’s Cyber Crime Cell, a Singapore-based Information Technology company — eSys Technologies Limited — has moved a criminal complaint against an unidentified source on charges of “cyber-defamation”. The company alleged that an anonymous mailer is circulating e-mails, which contain maligning statements about the group, sent from fake IDs to the public at large.

Based on the complaint, the Cyber Cell has initiated an investigation.

The eSys group, which has its global back-up office at Rajiv Gandhi Information Technology Park, has also filed similar complaints with the police cyber crime cells of Singapore, USA, Korea, Germany and Switzerland.

Neeraj Chaudhary, constituted attorney of eSys Technologies, has stated in the complaint that the e-mails are “distinctly obscene, vulgar, abusive, intimidating, humiliating and defamatory in nature and generated with the sole aim of maligning the reputation of the company’s management all over India and the world”.

Officer-in-Charge of the cyber cell, Sub-Inspector Hardit Singh, said: “We have recorded a few statements of the people who received the e-mails. We are in the process of tracing the source and will track the server from which the mails were generated. We hope to nail the person soon.”

According to the complainant, the e-mails could be the outcome of eSys having opposed the illegal termination of its worldwide distributorship by Seagate Technologies Ltd, USA. However, the concerned police officers said it is premature to say anything on the issue at this stage.

As per the law, ‘cyber defamation’ means defamation carried out with the help of computers or the Internet. This includes publication of defamatory matter about someone on websites or sending of e-mails containing defamatory information.

In India, cyber defamation through a fictitious e-mail ID is punishable under Sections 463 and 469 of the Indian Penal Code, incurring imprisonment upto three years and a fine. For offences punishable under Section 67 of the IT Act, 2000, the penalty is rigorous imprisonment for two years and fine.
