The petitioner asked for a ‘hobbies corpus writ’ in the wake of alleged illegal detention of his daughter. When the matter came up before a division bench of Justice S B Mhase and Justice Amjad Sayed, the court asked the counsel as to what writ the petitioner wanted since the petition read ‘hobbies corpus.’
The counsel contended that it was a spelling mistake after which the court directed the petitioner to correct the mistake.
The court observed, “The counsel was not in a position to correct the mistake and he could not even pronounce the correct writ which was desired to be issued by the court.”
Dismissing the petition the court observed, “Since the remedy claimed for is not available with the court, the petition is rejected.”
