Rajesh Garg, a resident of BRS Nagar, in a complaint before the District Consumer Disputes Redressal Forum had stated that he along with his family had decided to enjoy the new year’s eve at Mumbai and he, through the internet, got the tickets reserved with Spice Jet Airlines from Delhi to Mumbai for December 30, 2005 and made the payment through a credit card. On the scheduled date, he along with his four family members boarded the Spice Jet flight from Delhi to Mumbai but after reaching Mumbai airport, he was shocked to know that his baggage, which had goods worth about Rs 1.49 lakh, had been lost.
Garg further stated before the forum that he reported the matter to concerned authorities and an irregularity report was also issued by the concerned officer to Garg. Despite best efforts and running from pillar to post, he could not get the baggage. He also wrote many letters to airline authorities.
Later on January 17, 2006, Garg received a letter from the customer relations department of the airlines through which, while feeling sorry for baggage loss, the airlines sent him a cheque for Rs 3,000, which Garg refused to accept stating that the loss suffered by him amounted to Rs 1.49 lakh.
During the arguments, the representative of Spice Jet Limited stated that on January 9, 2006 the airline had retrieve the unclaimed baggage and telephonically requested Garg to identify the baggage but Garg refused for the same and sought compensation only.
After hearing the arguments of both sides, Forum president A S Narula and members held that though it was evident that the lost baggage had been found and the airlines also wanted to compensate the complainant by paying Rs 3000 but he refused to accept the amount and filed the complaint.
The Forum while accepting the complaint directed the airlines to pay a compensation of Rs 25,000.
