Rehman family’s counsel Advocate Kalyan Banerjee and CBI counsel Ranjan Roy opposed the plea, submitting that they should not be provided with a copy of the report, as they did not file an affidavit in this regard, in accordance with a High Court order passed on October 16, last year.
“The order had asked them to state their stand on the issue in the affidavit. So, they should not be allowed to go through the report before they file the affidavit,” the counsels maintained. In its October 16 order, the court had asked the state, the cops and Todi to file affidavits within November 30 last year.
On Friday, Justice Dipanakar Dutta asked both Banerjee and Roy to file affidavits opposing the disclosure of the CBI report within three weeks.
The state government, the police officers and Todi will have to file their replies within two weeks of the filing of affidavits. The matter will come up for hearing on February 20.
Advocate-General Bolai Roy, the state counsel, however, appealed for an extension of the time period for filing the affidavits.
Both Banerjee and Roy opposed this as the time limit had already expired.
Roy added that the agency wanted to proceed with its next course of action after placing the report before the High court on January 8.
