State gets court rap for bid to drop charges against Abu

New Delhi, March 7 A Delhi court today took the state government to task for moving an “ambiguous” plea to get MCOCA charges dropped against extradited gangster Abu Salem . The Delhi government’s petition was not supported by any authentic document.

Additional Sessions Judge Ravinder Kaur noted that the application for dropping the Maharashtra Control of Organised Crime Act (MCOCA) charges, filed by Additional Solicitor General Vikas Singh, was not supplanted with the affidavit India gave to Portugal authorities on the issue.

“Your application is ambiguous,” the judge told the ASG and asked him to file the affidavit given to the authorities in Portugal, from where Salem was extradited in November 2005, to the court by the next date.

As the ASG contended that Salem’s counsel had approached the Portuguese Supreme Court alleging breach of international commitment on the part of New Delhi by prosecuting him under the additional charges of MCOCA, the court stated that it should be informed in detail about Salem’s plea before courts in Portugal over the issue.

The judge has posted the matter to March 24 on the ASG’s request.
