Sukna land: HC extends stay on cancellation of lease agreement

Kolkata The Calcutta High Court has extended its stay on the cancellation of the lease agreement in the Sukna land case by eight weeks. Delivering the order on Wednesday, Justice Indira Banerjee also directed the state government to file an affidavit within four weeks on the petitions filed by private companies challenging the cancellation of lease in the case.

Advocate Saptangsu Basu, counsel of the Akshara Vanijya Company, pleaded that the stay on the land case should continue till the disposal of the case. The case will come up for hearing after six weeks.

The government had leased out 71.55 acres to Akshara Vanijya and three other companies for a commercial venture at Sukna in 2006. The lease deeds were executed for Rs 82 lakh. The four companies got the possession of the land in June 2007. The state had announced through an advertisement in 2009 that it has initiated a process to cancel the lease following an objection by the Army in November 2008. The four companies later filed petitions in the Calcutta HC in December 2009 alleging that the state government could not strike down the lease on the basis of an objection raised by the Army at Sukna. On December 23, Justice Tapen Sen stayed the proceedings on the cancellation of the lease agreement and asked the state and private companies to maintain a status quo on it until further orders.
