Tender row: Criminal complaint filed against PMC chief and police chief

Pune A private complaint seeking criminal action against the Pune municipal commissioner, police commissioner, police inspector of Shivajinagar police station, security officer of Pune Municipal Corporation and around 200 unidentified persons has been filed with Additional Chief Judicial Magistrate S T Dhawale by advocate Milind Pawar on behalf of Bharatiya Dalit Cobra president Bhai Vivek Chavan.

The complaint mentions that around 200 people, many of them armed with guns and other weapons, had laid seige outside the PMC building and outside the tender cell in the building at the behest of some contractors last Monday. On that day, tenders for work orders worth Rs 130 crore were to be submitted at the PMC tender cell. Armed people threatened contractors who had come to the file their bids and forced them to go away from the PMC office. But even then, all those -- named in the complaint -- refrained from taking any action against the offenders, Chavan said in his complaint.

The complaint stated that the accused should be booked under Section 143 of IPC, for unlawful assembly which restricted government work, Section 147, rioting by use of force or violence, Section 148, being armed with weapons likely to cause death, Section 119, when a public servant facilitates a commission of offence, Section 221, when a public servant aids in people liable to be apprehended for a offence to escape, Section 166, when a public servant fails to act even after knowing that his disobedience may cause harm to some other person.

An atmosphere of terror had been created at the PMC premises, which was intended to favour some contractors that could lead to misuse of Rs 130 crore of taxpayer’s money. But, this was averted as PMC commissioner dismissed the bids filed last Monday.

The complaint further mentions that PMC houses administrative officers responsible for running the city and people from all walks of life visit the corporation every day. The municipal corporation has appointed a security officer to see to it that no untoward incident happens in the PMC office premises. Even then, in broad daylight armed goons laid siege in the office premises. But the commissioner and the security officer did not take cognisance of such a big issue and did not register police complaint. The police commissioner and police inspector of Shivajinagar police station also ignored the issue and did not initiate action. So around 200 accused who were present at the PMC office last Sunday are roaming free, the complaint said.
