Kanpur Bahujan Samaj Party legislator Shekhar Tiwari accused of killing PWD executive engineer Manoj Kumar Gupta was remanded in judicial custody till February 25 by a special court on Friday.

Three co-accused in the case Vinay Tiwari, Manoj Awasthi and Ram Babu alias Puti were also remanded in judicial custody for the same period. All the four have been booked under the Gangster Act and taken to the Etawah district jail.

During the hearing, defence counsel Akhilesh Kumar Singh Gaur urged the court not to charge the MLA under the Gangster Act since he has already been booked under the same Act in a 2005 kidnapping case at Dibiyapur police station.

“The MLA is already facing trial in Gangster Court for his alleged involvement in 2005 kidnapping case, therefore I requested the Judge to withdraw Gangster Act from him in this murder case,” Gaur told mediapersons after the hearing. He also said that the court fixed January 24 for the next hearing in the kidnapping case. “Though the defence counsel appealed for the withdrawal of the new case under the Gangster Act, the judge fixed separate dates for the hearing in the two cases,” said Mahendra Kumar Yadav, who is representing the state in the case.
