Tobacco Act violations: 3 hotels issued challans

Chandigarh The state nodal officer, National Tobacco Control Programme, along with the inspector of LHA Chandigarh, inspected the hotels and restaurants in Sector 26 for any violation of the Control of Tobacco Products Act (COTPA) on Wednesday. The team inspected 15 premises and issued three challans for improper signage in the inspected premises. Nearly 80 persons were challan ed for smoking at public places by the enforcement agencies in the month of December last year, while a total of 642 challans were issued between April and December 31 last year for violations of various provisions of COTPA.

Under the new provisions of COTPA applicable from October 2, 2008, it has been specified that all public places and offices shall have a board containing the warning “No Smoking Area — Smoking here is an offence”. All public places/offices should prominently display this warning board, failing which the officer/manager in-charge of the premises is liable to be challan ed for violation under COTPA.

Those hotels or restaurants having more than 30 rooms or seating capacity of over 30 and those that opt for making a smoking enclosure in their premises shall have to ensure that any setup should be as per the law. No sale, supply or consumption of food and drink or service of any kind is allowed inside such enclosures. Such an enclosure should be physically segregated and surrounded by full height walls on all four sides. The entrance to such an enclosure should not be at the entrance or exit of the premises. Such closed enclosure should maintain a unidirectional air flow system.
