Mahajani and his partners Harischandra Nikam and Arun Harischandra Nikam were booked by the Pune police in 2003 under the relevant sections of the Maharashtra Ownership Flat Act following a complaint lodged by a flat owner Prashuram Narayan Redij (73) of Warje Malwadi. The court had framed charges against the accused on December 8, 2006.
On the first day of hearing, Redij was examined before the magistrate Kalpana Patil by the Assistant Public Prosecutor Anil Ausekar.
Redij said that he had purchased a flat worth Rs 6,14,250 at Rashmi Residency at Survey No. 43 at Warje on June 10, 1998. Redij said that for attracting the customers, the accused had published an advertisement in newspapers with assurances to provide several amenities like solar lights, swimming pool, indoor club and much more.
The accused mortgaged the building without the taking consent of the flat owners. They asked the flat owners to repay the building loan if they want the amenities. Redij said the accused not only failed to provide the amenities, but failed to register the sale deeds and the society despite collecting Rs 35,000 each from all the flat owners.
